Walkmates – Terms of Use

Walkmates.com (“Walkmates”, “the platform”) is operated by Ninvoice Limited (“we”, “us”, “our”).
By accessing or using Walkmates, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must not use the platform.
Walkmates is a self-service discovery and social platform. Ninvoice Limited does not organise, lead, supervise, endorse, verify, insure, or provide professional guidance for any walks, routes, users, or activities listed on the platform.
1. Acceptable Use
You may use Walkmates to:
- Discover, create, list, and join walks.
- Share content such as photos, comments, routes, and “Ghosts”.
- Interact with other users in a lawful, respectful manner.
You must not:
- Post or share content that is illegal, misleading, defamatory, threatening, abusive, sexually explicit, or otherwise harmful.
- Harass, stalk, intimidate, impersonate, or endanger other users.
- Promote violence, hatred, or illegal activity.
- Attempt to access, interfere with, disrupt, reverse-engineer, or misuse the platform or its infrastructure.
- Scrape data, use bots, automated tools, bulk messaging, or spam systems without explicit written permission.
- Use Walkmates for advertising, commercial activity, or lead generation without prior written consent.
We reserve the right to investigate, restrict, suspend, or terminate access for any breach of these terms, with or without notice.
2. Personal Responsibility, Ability & Safety
You are solely responsible for your own decisions, actions, and safety.
By using Walkmates, you explicitly acknowledge and agree that:
Ability & Fitness
- You must never participate in a walk, route, or activity beyond your own physical ability, fitness level, navigation skill, or experience.
- You are responsible for assessing your health, stamina, medical conditions, equipment, and preparedness.
- Walkmates does not assess, verify, or advise on fitness, competence, or suitability.
Routes & Conditions
- All routes, walks, descriptions, distances, ascent, difficulty ratings, and timings may be inaccurate, incomplete, outdated, or misleading.
- Weather, daylight, terrain, access rights, livestock, traffic, river levels, and ground conditions may change rapidly.
- You must independently verify all information and conditions before and during any walk.
Specific Acknowledged Risks
You accept that outdoor walking and related activities may involve foreseeable risks including, but not limited to:
- Slips, trips, falls, and falls from height
- Navigation errors, becoming lost, or delayed
- Sudden weather changes including cold, heat, wind, rain, snow, or ice
- Exhaustion, dehydration, hypothermia, heat illness, or medical emergencies
- Injury from terrain, livestock, wildlife, fences, gates, stiles, or public roads
- Equipment failure or inadequate clothing or footwear
- Delayed access to emergency services or lack of mobile signal
You knowingly and voluntarily accept all such risks, whether foreseeable or not.
Other Users
- Users are not vetted, trained, supervised, or monitored.
- You are responsible for your own interactions and decisions to meet or walk with others.
Walk Creators & Organisers
- Users who create or list walks do so solely in a personal, non-professional capacity.
- They are not leaders, guides, instructors, or responsible persons.
- They owe no duty of care, supervision, or responsibility to you.
Emergencies
- You must make your own emergency and contingency plans.
- Always inform someone outside the platform of your plans.
3. User Content & Licensing
Ownership
You retain ownership of content you submit to Walkmates.
Licence to Walkmates
By uploading or posting content, you grant Ninvoice Limited a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable licence to host, store, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the operation, improvement, promotion, analytics, and future development of Walkmates.
This licence survives account deletion.
Public & Persistent Content
- Public content may remain visible indefinitely.
- Deleting your account does not guarantee removal of content that has been shared, indexed, cached, or embedded within the platform.
Moderation
- We may remove, restrict, retain, or refuse content at our discretion.
- We are under no obligation to monitor or moderate content.
You are solely responsible for the legality, accuracy, and consequences of content you post.
4. Accounts & Eligibility
- You must be at least 18 years old to use Walkmates.
- You are responsible for all activity carried out through your account.
- You must keep login credentials secure and confidential.
Ninvoice Limited may suspend or terminate accounts at any time, without liability, for:
- Breach of these terms
- Misuse of the platform
- Risk to other users or to Walkmates
- Legal, regulatory, or operational concerns
We are not liable for loss of access, content, or data resulting from enforcement actions.
5. Platform Availability, Data & Reliability
Walkmates is provided “as is” and “as available”.
You acknowledge and agree that:
- We do not guarantee continuous availability, uptime, or error-free operation.
- Data may be lost, corrupted, delayed, duplicated, or become inaccessible due to system failures, software bugs, security incidents, maintenance, upgrades, migrations, or third-party service failures.
Ninvoice Limited is not responsible for loss of data, including but not limited to:
- User accounts
- Walks or routes
- Messages or communications
- Photos, comments, or other uploaded content
- Activity history, achievements, or progress
You are responsible for maintaining your own backups of any content you consider important.
6. Intellectual Property
All software, branding, trademarks, logos, and design elements are owned by Ninvoice Limited or its licensors.
You must not copy, reuse, or exploit these without explicit written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Ninvoice Limited, including its directors, officers, employees, contractors, agents, contributors, and affiliates, excludes all liability for any injury, death, loss, damage, cost, or expense arising from or related to:
- Use of or inability to use the platform
- Loss, corruption, or unauthorised access to data or content
- Participation in any walk or activity
- Reliance on routes, descriptions, timings, difficulty ratings, or user content
- Interactions with other users, online or offline
- Weather, terrain, equipment, navigation, or environmental conditions
This includes direct, indirect, incidental, consequential, special, and economic loss.
Nothing in these terms limits liability where such limitation is prohibited by law.
8. Indemnity
You agree to indemnify and hold harmless Ninvoice Limited, its directors, officers, employees, contractors, agents, and contributors from any claims, losses, damages, liabilities, costs, or legal expenses arising from:
- Your use of Walkmates
- Your participation in activities
- Your interactions with other users
- Your content or conduct
- Any breach of these terms
9. Governing Law
These terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
